PERPETUAL MEMBERSHIP AGREEMENT: INITIALS:
Motion Fitness hereby grants and the undersigned Member accepts a Membership entitling the undersigned member the use of Motion Fitness facilities subject to the rules and regulations and operating hours as prescribed for the members from time to time by Motion Fitness. This agreement shall begin on April 30, 2025 and continue until terminated by either party in accordance with this agreement.
AUTOMATIC RECURRING PAYMENT AUTHORIZATION: INITIALS:
I, {First Name} {Last Name} authorize Motion Fitness to charge my billing information for the payment of my Motion Fitness gym membership. I understand that this authorization will remain in effect until I cancel it in writing and I agree to notify Motion Fitness of any changes in my billing information.
*An Annual Enhancement Fee: $25+GST (per person on family membership), will be charged 2 months following sign up and will be a reoccurring annual fee.
FOR VALUE RECEIVED, I (we) jointly and severally promise to pay to the order of Motion Fitness the sum of 31.99 + GST biweekly for all payments commencing April 30, 2025. All parties hereto, including co-makers, sureties, guarantors, and endorsers severally waive demand and presentment for payment, notice of nonpayment.

TERMS AND CONDITIONS: INITIALS:
First Three days: You may cancel your agreement without any penalty or further obligation in person, provided a signed cancellation is submitted with request to terminate the agreement within 3 days of your agreement start date. After those three days, the agreement is no longer fully refundable, and your financial obligation continues whether or not you use the facilities. We sincerely hope you will utilize our facilities.
15 Day Customer Satisfaction Guarantee: You may cancel your Membership without any penalty or further obligation in person, provided a signed cancellation is submitted with request to terminate the agreement to Motion Fitness within 15 days of your membership. The initial fees paid are non-refundable.
Long Distance Change of Permanent Residence: If you move your permanent residence more than 30 km from Motion Fitness and there are no Motion Fitness facilities to service you, you may transfer your Membership to another party (at a cost of $50.00), providing the Membership is in good standing. You are responsible for finding the party to transfer your membership. To be eligible, you must provide us with verification that your new address is a change in your permanent residence. You must pay any arrears on your Account prior to transferring your Membership.
Suspension and Termination: Motion Fitness reserves the right to suspend or terminate this agreement for any violation of the terms, rules, policies, or for non-payment of fees.
Membership Expiration: If you are paying biweekly dues under a 1 Year Membership, once the Membership expires, you automatically convert to a monthly membership. At the time your Membership is due to expire, and anytime thereafter, you may cancel your Membership by giving us 30 days' written notice. If the cancelling member is a family add on to a billable member, 30 days’ notice of cancellation will still apply. If an arrears situation exists, the amount owing will remain applicable and will continue to be withdrawn after the cancellation date takes effect. You will be billed for the period of 30 days after your notice is received by us, and then will be pulled from any future billing. We do not accept cancellation request over the phone. All cancellations must be received in person or by registered mail only. A signature is required for all cancellation requests.

Time Stops: You may freeze your Membership for up to 3 months per calendar year. The cost to freeze your Membership is $3.00+GST bi-weekly and all requests must be given with 7 days’ written notice. Membership freezes must be provided with a start and end date based on the existing payment schedule. After the freeze period is over, the membership will be automatically unfrozen. You may also unfreeze your Membership before the freeze end date, by submitting a written notification. Freeze can only be done in 2 week increments, and in the case of a Family membership, a freeze can only be done to the primary person and will apply to all attached memberships. If the Annual Maintenance Fee is scheduled to be withdrawn during the time of the freeze period, it will be processed as scheduled. If account is in arrears, the balance owing will be picked up in addition to the biweekly freeze dues. The duration of the freeze will be added to the end of their 1 year term.
Billing and Collections: If your account becomes 90 days delinquent or your automatic bank payment authorization is cancelled for any reason, the entire balance of the agreement becomes due and payable within 15 days. The member will be liable for payment of all costs incurred by Motion Fitness in the collection of past due obligations. All returned payments are subject to a $30.00 administration fee. Motion Fitness Collection department may attempt at ANY time to collect dishonored payments and outstanding balances prior to your next billing date.
Unsettled balance will be at risk of going to a third party collections agency and will be subject to a $100+GST collections fee.
Tanning and Red Light Therapy: I hereby confirm that no warranty or guarantee, or other assurance, has been made to me covering the results of the indoor sun tanning and red light therapy process, and I hereby relieve them and hold them harmless from all liability for injury or damage that may occur to me. I fully understand the administration of the indoor sun tanning and red light therapy process, including possible adverse skin reaction, side effects, or other possible complications. Members under the age of 18 are NOT allowed to use the tanning and red light therapy.
It is agreed that Motion Fitness, its owners, agents, employees, successors and licensors shall not be responsible for members’ or their guests’ articles lost or stolen in the gym or damage to any other property, including automobiles and other methods of transportation and shall not be liable to any member or their guests for the actions, negligence, errors or omissions of another members of this facility or their guests.
Member agrees to abide by all the Membership Rules and Regulations of the club. In recognition of the risks related to physical activity, the Member hereby knowingly and voluntarily waives any right to cause of action of any kind whatsoever arising as a result of such activity from which any liability may or could accrue to Motion Fitness, its officers, agents, employees, or instructors. Should the Member default, the Member shall be responsible to pay court costs and reasonable attorneys’ fees all of which may be paid or incurred by Motion Fitness. The Member also agrees that there are no representations other that what is agreed to in writing herein. Failure to use the facility will not relieve the Member of payment.
Motion Fitness shall have the right, without invalidating, cancelling or affecting this Membership Agreement, to make changes (including changes in prices, contents and terms) to this Membership Agreement at any time without notice to the Member. Notwithstanding the above, Motion Fitness shall use its best efforts to give Members two (2) weeks’ notice of any changes to the Membership Agreement.
Your Rights Under The Consumer Protection Act
You may cancel this contract at any time during the period that ends seven (7) business days after the later of the day you receive a written copy of the contract and the day all the services are available. You do not need to give Motion Fitness a reason for cancelling during this period. In addition, there are other grounds that allow you to cancel this contract. You may also have other rights, duties and remedies at law. For more information, you may contact the Consumer Protection Branch, Saskatchewan Justice. To cancel this contract, you must give notice of cancellation to Motion Fitness at 431-A Nelson Road, Saskatoon, Saskatchewan, S7S 1P2 by personal service, registered mail or any other means set out in the contract. If you cancel this contract within seven (7) days, Motion Fitness has fifteen (15) days to refund any payment.
CONSENT TO RECEIVE ELECTRONIC CORRESPONDENCE
I agree and consent to receiving electronic correspondence and newsletter containing information about my membership, updates and promotions from Motion Fitness at the email provided above and also giving permission to receive text messages to number provided (12/15/21). I understand my consent can be withdrawn at any time.
Please consult your physician prior to starting an exercise or fitness program, and prior to using the Facility.
I acknowledge that I have read and understood the agreement and freely consent to its terms.
NOTE: ONLINE SIGNUPS
- With online signups you will pay your initial join fee up front and then about 3 days later your dues will follow.
- Member has read and understands the above release and indemnity and agrees to the terms thereof. *Submission of this agreement online will act in place of a physical signature.

Since your child is below the age of 18 years, we require your consent and signature authorizing him/her to purchase Membership and/or Personal Training with Motion Fitness. Please be aware that by signing consent, you take full responsibility for all the contractual obligations of the agreement they are signing.
Rules and Stipulations:
- All children under 12 years of age are not permitted access to any type of Membership with Motion Fitness and cannot use any of the facilities and amenities aside from Childcare. Some exceptions allowed for Personal Training.
- Children 12 and 13 years of age are required to have a parent/guardian/trainer present with them at all times when they are at the gym.
- Children between 14 and 17 years of age may use the facilities as per terms of this agreement unsupervised provided that parental/guardian consent was received.
- In regards of drop-in services, an individual under 18 years of age requires parental consent and if under 14 years of age, they must have a parent/guardian present with them. No child under 12 years of age can use drop-in service.
